Terms of service and sale
By creating an account or using Awaitee, a customer accepts these terms. They cover the account holder’s relationship with the service; a visitor of a customer’s site, going through its waiting room, is never a party to them.
Professional customers only
Awaitee is sold to professionals only. By creating an account, the account holder declares acting for the purposes of their trade, business, craft or profession, or on behalf of an organisation, and not as a consumer. The provisions of consumer law that protect consumers alone, the right of withdrawal and consumer mediation in particular, therefore do not apply.
Purpose
Awaitee is a virtual waiting room a customer adds to their site for an announced peak: registrations opening, a limited sale, ticketing. Visitors who arrive before the opening get their place at random at the opening; those who follow go in their order of arrival. The queue moves on as seats free up on the site, within the capacity and the entry rate the customer sets.
The service and its limits
The customer pastes one line of JavaScript into the pages of their site, or installs the WordPress plugin that does it; nothing runs on their server. The queue protects visitors who come through a browser: they wait in line, in order, and the customer’s server gets at most the number of people set. It does not protect against a request sent straight to the cart, the checkout or any other address of the site without loading its pages: such a request bypasses the queue, and no line of JavaScript can stop it. Awaitee is not a protection against bots; the Turnstile and per-IP limit options only slow down places taken in bulk in the queue.
Outages
If the service is down, or if the script gets no answer within a short delay, the site’s pages show as usual, without a queue: the site stays open to everyone rather than closed. Likewise, an outage of the Turnstile check or of the per-IP count lets visitors in.
Account and settings
The account holder is responsible for the accuracy of their events’ settings (site address, times, protected pages, capacity, entry rate) and for installing the script line on their site. They sign in through a link sent to their email address, and keep access to that mailbox confidential. An event lasts 7 days at most, from the opening of the waiting room to the end of the protection. An event ends at its end time, or earlier when the customer stops it from the dashboard; stopping is final and opens the site to everyone within a minute.
Pricing
Every event starts as a free trial, up to 20 visitors. The paid tiers (Event, 10,000 visitors, €29; Large event, 50,000 visitors, €49; Very large event, 200,000 visitors, €99) are paid once per event, with no subscription, at any time, even during the event; moving to a higher tier costs the difference. A visitor counts as soon as they get a place in the waiting room. Past the tier’s threshold, new arrivals go straight to the site, without a queue; those already in line keep their place. Prices are shown VAT included. A tier is sold and invoiced by Stripe (Stripe Payments Europe, Ireland), which resells the service in its own name, collects the payment and works out, charges and pays the VAT; Stripe’s terms of sale apply to the payment and the invoice.
No refunds
A paid tier is never refunded, including when the event is stopped early, does not take place or does not reach its threshold.
Price changes
Awaitee may change its prices. A new price only applies to payments made after it is published; a tier already paid remains acquired for its event.
Limitation of liability
Awaitee is provided without warranty of uninterrupted availability. The publisher cannot be held responsible for lost sales, an overload of the customer’s server, purchases made outside the queue or any indirect damage. In any case, its liability for an event is limited to the price paid for that event, that is zero for an event left on the free trial.
Account deletion and suspension
An account holder may delete their account from the “Your account” page of the dashboard, once their running events are stopped or over, or ask for it by writing to hello@awaitee.com; their events and their data are then deleted. The publisher may suspend an event that breaches these terms or serves an unlawful activity.
Governing law
These terms are governed by French law. The service being sold to professionals only, any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Nantes, France.
